A practice manual for renewing Vietnamese trade mark registrations. What trips up management here is the definition of "done". In most jurisdictions renewal completes on payment; Vietnam examines the request and issues a decision. That takes three to four months, so closing the matter on the day of payment means nobody sees the notices or deficiencies that follow.

2. Anchor date and due-date calculation
The anchor is the filing date. Renewal falls due on its tenth anniversary, with the window opening six months earlier.
Worked example
For a registration filed 2020-06-15.
| Item | Formula | Date |
|---|---|---|
| Window opens | Expiry − 6 months | 2029-12-15 |
| Renewal due | Filing + 10 years | 2030-06-15 |
| Grace ends | Due date + 6 months (10% per month) | 2030-12-15 |
| Renewal decision | 3 to 4 months after filing | Depends on when it is filed |
| Next due date | Every 10 years thereafter | 2040-06-15 |
3. Filing and examination
- The window opens six months before expiry.
- The request is examined as to form and requirements, and a renewal decision issues, typically after three to four months.
- Completion is the decision, not the payment.
- The renewal is endorsed on the original certificate, which may require sending the original to the office and receiving it back.
- Where Vietnam is designated through an international registration, renewal goes to WIPO.
4. Grace period and surcharge
| Item | Detail |
|---|---|
| Grace period | 6 months from the due date |
| Surcharge | 10% per month, multiplied by the months elapsed |
| Basis | One month late is 10%; six months late is 60% |
| If missed | The right lapses — no restoration |
5. Lapse and restoration
After the six-month grace period the registration is gone and no procedure revives it; only refiling remains. Because the surcharge accrues monthly, delay within the grace period keeps raising the cost.
6. Official fees
The Vietnamese renewal cost is not a single amount but a sum of components. Some are charged per class and others per request, so estimating from the class count alone goes wrong.
| Item | Basis | Amount (VND) |
|---|---|---|
| Renewal fee | Per class | 100,000 |
| Use fee | Per class | 700,000 |
| Examination fee | Per request | 160,000 |
| Grace surcharge | 10% per month on the above | — |
7. Management checklist
- The filing date, from which expiry is derived.
- Track status as filed, under examination and decided; do not close the matter on payment.
- Because examination takes three to four months, default to filing as soon as the window opens.
- The class count and the request count, since the components are charged on different bases.
- Whether the original certificate is needed, since the renewal is endorsed on it.
- Whether the case is a direct filing or a Madrid designation, since designations renew at WIPO.
- No restoration and a monthly surcharge — delay inside the grace period keeps costing more.
