Mexico Patent Annuities: Management Manual

Annuities for Mexican (MX) patents are not paid every year; they are prepaid in five-year (quinquenio) blocks. The deadline is likewise set not by a "date" but by the "month" in which the filing-date anniversary falls. This manual is for applicants and corporate managers holding Mexican patents, and for the IP firm staff who manage them, setting out in order the anchor date, start of payment, grace period, restoration, fee reductions, fees and a checklist so that no deadline is missed.

2. Anchor date and deadline calculation

The anchor date for Mexican patent annuities is the filing date. The first thing to confirm is that it is not the registration (grant) date. The term is likewise calculated as filing date + 20 years.

The deadline is "within the month in which the filing-date anniversary falls." The most distinctive feature of Mexico is that this is a monthly window rather than a day-based deadline. In practice, however, it is safer not to leave it until the end of the month and instead to set the anniversary itself as the internal deadline.

The exception is the first payment. Only the first payment is made within 2 months of the notice of allowance. In other words, for the first instalment the period runs from the notice of allowance, not from the filing-date anniversary month.

Calculation example

The following deadlines are calculated under the above rules for a hypothetical case (filing date 2020-06-15 · registration date 2023-03-10).

Because the filing date is June 15, all subsequent renewal deadlines fall in June. Payment events occur only once each in 2025, 2030 and 2035, at five-year intervals. If the filing date is blank in the case master record, none of these three deadlines can be calculated.


3. Start of payment

Mexico has no pre-grant annuities. No annuity obligation arises while the application is pending.

At grant (within 2 months of the notice of allowance), the year of grant plus the following 4 years — that is, 5 annuities — are prepaid at once. Thereafter payments are prepaid in five-year blocks.


4. Grace period and surcharge

There is a grace period of 6 months after the deadline.

The surcharge is not a fixed rate but is calculated in linkage with the Federal Tax Code (CFF). It is computed automatically by IMPI's PASE portal.


5. Lapse and restoration

Mexico has a restoration system (rehabilitación). It can be requested within 6 months after the end of the grace period.

6. Fee reductions

Mexico has a 50% fee reduction. It applies to individual inventors, micro/small enterprises, universities and public research institutions.

Those eligible for the reduction may elect annual payment instead of the mandatory five-year block prepayment. In other words, eligibility affects not only the fee amount but also the choice of payment cycle.


7. Prepayment and lump-sum payment

In Mexico, five-year block prepayment is mandatory. Annual payment can be elected only by those eligible for the fee reduction.

It is also possible to pay for all remaining years at once. Where lump-sum payment is chosen, subsequent deadline reminders must be cleaned up so that no unnecessary alerts remain.

8. Official fees

Fees are shown in two tiers: the pre-tax amount and the amount including 16% IVA. The amounts in the table below have remained unchanged since 2018.

9. Management checklist

Items to check first in the case docket

  • Filing date — it is both the anchor date and the basis for the term (filing date + 20 years). If this value is blank, not a single five-year cycle deadline can be calculated and the entire deadline schedule falls apart. This is the top priority check item.
  • Registration date and notice of allowance date — the first payment falls in the 2-month window from the notice of allowance, so without this date the first deadline cannot be set.
  • Payment cycle setting — confirm that the case is registered as a five-year event, not an annual one.
  • Reduction eligibility — whether the case qualifies as an individual inventor, micro/small enterprise, university or public research institution, and whether annual payment has been elected.
  • Assignment history — if the right has been transferred to a non-eligible party, check whether back payment (clawback) of the reduced amount applies.
  • Whether a lump-sum prepayment was made — if all remaining years have already been paid, clear the remaining deadlines.

Payment cycle workflow

  1. Determine the deadline month for the current quinquenio from the filing date (the month in which the filing-date anniversary falls).
  2. List the annuity numbers included in that five-year block, check whether it straddles a band boundary, and add up the fees.
  3. Reconfirm reduction eligibility. Also check whether there has been any change in eligibility or any transfer of rights.
  4. Obtain the right holder's instruction on payment (maintain or abandon). Since this covers five years' worth of fees, seek the instruction earlier than usual.
  5. Start the payment procedure before the deadline month begins. Even though it is a monthly window, do not leave it until the end of the month.
  6. After payment, attach the receipt evidence to the case and register the next quinquenio deadline (the same month five years later).
  7. If the deadline month has passed, flag that the case is in the 6-month grace period and switch immediately to the payment procedure. Verify the surcharge as the amount computed at the time of payment.
  8. If the grace period has also passed, check whether the restoration window (6 months after the end of the grace period) is still open and, if so, escalate the case as top priority.

For Mexican cases, deadlines come rarely, but missing one puts a full five years at risk.
