Terms of Service

These Terms of Service ("Terms") form a binding agreement between you ("you", "User", "Member") and iphere (sole proprietorship, Republic of Korea) ("we", "us", "the Company") regarding your use of iphere (the "Service"). By creating an account or using the Service, you agree to these Terms.

This English version applies to users outside the Republic of Korea. Korean residents should refer to the Korean version (한국어).

iphere is an online platform that helps applicants and rights holders:

The Service is provided as software-as-a-service. Filing decisions, legal strategy, and the accuracy of submitted content remain your responsibility unless we explicitly agree otherwise in writing.

2. Eligibility & Accounts

You must be at least 14 years old (and meet the age of digital consent in your country) to use the Service. By using the Service, you represent that the information you provide is accurate and that you are authorized to act on behalf of any organization or third party whose data you submit.

You are responsible for safeguarding your account credentials. Notify us immediately at security@ip-here.com if you suspect unauthorized access.

3. Fees, Government Fees, and Payment

Charges in iphere fall into two distinct categories:

Payments are processed by Toss Payments (Korea) or Stripe (international). We do not store full card numbers.

You retain all rights in the data, documents, and materials you upload (collectively, "Your Content"). You grant us a non-exclusive, worldwide, royalty-free license to host, process, transmit, and display Your Content solely as needed to operate, improve, and secure the Service and to comply with law.

You represent that you have the rights necessary to upload Your Content and that it does not infringe any third party's rights.

6. Intellectual Property of the Service

All software, design, content, and trademarks of the Service are owned by us or our licensors. We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms. You may not copy, modify, distribute, or create derivative works of the Service.

7. Service Availability

We aim to provide the Service 24/7 but may suspend it for maintenance, upgrades, or for reasons beyond our reasonable control (force majeure, KIPO outages, etc.). We will give reasonable advance notice of planned downtime where practical.

8. Deadline Reminders

Reminders, calendars, and dashboards in iphere are convenience tools. You remain solely responsible for monitoring and meeting your deadlines (filing, response, annuity, renewal). Missing a deadline because a reminder was not sent or not seen does not give rise to liability beyond the limits in Section 11 unless we are demonstrably and grossly negligent.

9. Termination

You may terminate your account at any time from the Service. We may suspend or terminate your account if you breach these Terms, if continued service is unlawful, or if we discontinue the Service.

On termination, we will retain only the data legally required (tax, anti-fraud, IP filing records) for the periods set out in our Privacy Policy.

10. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, or the absence of errors. We do not warrant that filings will result in granted rights, or that any given strategy will succeed.

We are not your attorney unless we expressly enter into an engagement with you in writing. The Service does not constitute legal advice.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

These limitations do not apply to liability that cannot be excluded by mandatory law (e.g., gross negligence, willful misconduct, death or personal injury).

12. Indemnity

You agree to indemnify and hold us harmless from claims, damages, and reasonable legal fees arising out of (i) Your Content, (ii) your breach of these Terms, or (iii) your violation of any law or third-party right.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Korea, without regard to conflict-of-laws principles. Disputes will be subject to the exclusive jurisdiction of the courts of the Republic of Korea (Seoul Central District Court as the court of first instance), unless mandatory consumer-protection law in your country gives you the right to sue in your local courts.

If you are a consumer in the EEA, UK, or Switzerland, you may also file a complaint with the European Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

14. Changes to These Terms

We may update these Terms. For material changes that affect your rights or obligations, we will notify you by email and/or in-product banner at least 30 days before they take effect. For non-material changes, we will post the updated Terms with a new effective date.

If you continue to use the Service after the new Terms take effect, you are bound by them. If you do not agree, you may terminate your account.
