A practice manual for maintaining Mexican trademark registrations. Mexico sets two traps. The first is that the expiry date is anchored on the registration date for some cases and the filing date for others. The second is a declaration of use falling due at the third anniversary of registration — a filing that cannot be extended and whose omission causes the registration to lapse without any notice at all.

2. Anchor date and due-date calculation
A change in the law moved the anchor for expiry. Registrations issued on or after 2020-11-05 run ten years from the registration date; earlier ones run ten years from the filing date. When taking over an older portfolio this has to be checked case by case, because getting it wrong shifts the expiry date by years.
Worked example
For a case filed 2020-06-15 and registered 2023-03-10, the registration-date anchor applies and the deadlines are as follows.

3. The declaration of use appears twice

- The third-year declaration applies to registrations issued on or after 2018-08-10; earlier registrations are outside it.
- Madrid designations of Mexico are covered too. Renewing the international registration does not substitute for the declaration.
- The declaration lists the goods actually in use; anything not in use falls outside that scope.
- A renewal request must include the declaration. Remitting the fee alone does not move the case forward.
4. Renewal window and grace period

5. Lapse and restoration
If the renewal grace period passes, or the third-year declaration is missed, the registration is gone; there is no revival procedure and refiling is the only route. The third-year lapse in particular happens silently, so the case file alone will not show whether the right is still alive. Keep the filing receipt for the declaration on the case record.
6. Official fees
Renewal fees are charged per class with value added tax on top. The figures below are indicative and move with official fee revisions and exchange rates, so confirm the current schedule when quoting.

7. Management checklist
- Establish whether the anchor is the registration date or the filing date; registrations from 2020-11-05 onwards use the registration date.
- Docket the third anniversary plus three months as an item separate from the renewal. There is no extension and no notice.
- Check whether the registration issued on or after 2018-08-10, which decides whether the third-year declaration applies.
- Madrid designations are covered too, so make sure a renewal flag does not cover that reminder.
- File the declaration together with the renewal request; the fee alone will not do.
- Confirm actual use with the client before each declaration.
- The class count, since fees are charged per class.
- Do not plan around the grace period, because there is no restoration.
