United Kingdom Trademark Renewal: Management Manual

A practice manual for renewing United Kingdom trade mark registrations. The United Kingdom is comparatively forgiving: even after the grace period there is a restoration route. Its distinctive risk lies elsewhere — the comparable rights created by Brexit expire on the same day as the EU marks they came from, so it is easy to handle one and close the other.

2. Anchor date and due-date calculation

The anchor is the filing date. Registration takes effect from filing, so however long examination took, expiry is measured from the filing date. Renewal falls due on its tenth anniversary.

Worked example

For a registration filed 2020-06-15, the first renewal runs as follows.

3. The renewal window

  • The window opens six months before expiry.
  • Renewal completes on payment and requires no proof of use.
  • Classes may be dropped at renewal, reducing the fee accordingly.
  • The registry sends a reminder, but it carries no legal obligation. Reminding is our responsibility.

5. Lapse and restoration

After the six-month grace period the registration is removed. The United Kingdom adds one further step: restoration can be requested between six and twelve months after expiry.

7. Brexit comparable rights

  • Every EUTM on the register at 2021-01-01 generated a comparable UK right automatically.
  • Those rights inherit the expiry date of the original EU mark; the term is not recalculated from a UK filing date.
  • Renewal fees are payable to both offices, so budget for two.
  • Renewal fees paid early to the EU office before 2021-01-01 had no effect on the comparable UK right; check the UK payment history separately for cases from that period.
  • Marks filed directly in the United Kingdom afterwards are unaffected and follow the ordinary filing-date rule.

8. Management checklist

  1. The filing date, from which expiry is derived.
  2. Whether the right is a Brexit comparable right or a direct UK filing; the former inherits its expiry from the EU mark.
  3. Whether the same client also holds the EU mark, in which case two matters fall due on the same day.
  4. The class count, given the split between the first and additional classes.
  5. Whether any class should be dropped this cycle.
  6. Restoration runs from six to twelve months after expiry but is discretionary and non-refundable — do not treat it as slack.
